SUBSCRIPTION AGREEMENT (\u201cAGREEMENT\u201d) ENTERED INTO BY AND BETWEEN THE PERSON IDENTIFIED AS THE SUBSCRIBER (\u201cSUBSCRIBER\u201d) AND THE COMPANIES THAT FORM THE COMMERCIAL GROUP KNOWN AS WOBI (\u201cWOBI\u201d), HEREINAFTER JOINTLY REFERRED TO AS THE \u201cPARTIES\u201d, WHO AGREE TO BE BOUND BY THE FOLLOWING:<\/strong><\/p>\n Statements<\/b><\/p>\n The Subscriber declares, under their own responsibility, that: WOBI declares, through its representative, that: The Parties acknowledge the truthfulness of the above statements and agree to enter into this Agreement under the following:<\/span><\/p>\n Clauses<\/b><\/p>\n FIRST.- PURPOSE: \u00a0WOBI grants to the Subscriber a personal annual membership that will give the Subscriber access to a wide variety of digital, and physical or face-to-face business content carefully selected by WOBI (\u201cSubscription\u201d or \u201cMembership\u201c). WOBI grants the Subscriber a right to access the services and content of WOBI under the terms provided herein. The Subscriber may access the Subscription through certain devices connected to the internet and, in the case of face-to-face events, through their official identification and\/or customer number with which their tickets will be generated.<\/span><\/b><\/p>\n O Subscritor poder\u00e1 aceder ao conte\u00fado presencial da WOBI apenas no pa\u00eds onde estabeleceu a sua Assinatura e ao conte\u00fado digital nas localiza\u00e7\u00f5es geogr\u00e1ficas onde contratou a sua Assinatura. De entre estes Benef\u00edcios, a WOBI oferece ao Subscritor a oportunidade de participar no <\/span>World Business Forum<\/span><\/i> (\u201cWBF\u201c) of the country where the Subscription or its respective renewal was established.<\/span><\/p>\n Esclarece-se que a WBF, \u00e0 qual o Subscritor ter\u00e1 direito a participar, \u00e9 uma confer\u00eancia empresarial presencial realizada nos locais e datas indicados no site da WOBI de cada WBF (\u00e0 qual o Subscritor adquiriu a sua Associa\u00e7\u00e3o); e cujo acesso ser\u00e1 gerado pela WOBI a favor do Subscritor de acordo com as regras, hor\u00e1rios e formatos da WBF correspondente, bem como de acordo com a categoria de bilhete que tenha sido adquirida pelo Subscritor.<\/span><\/p>\n Nos casos especificamente informados pelo Cliente \u00e0 WOBI, o utilizador da conta de conte\u00fados digitais poder\u00e1 ser diferente da pessoa que utiliza o passe WBF correspondente.<\/span><\/p>\n Pol\u00edtica de cancelamento e reembolso de ades\u00e3o e acesso \u00e0 WBF: World Business Forum Membership and access cancellation policy<\/b><\/span><\/p>\n \u2013 If the Subscriber is unable to attend the WBF of the current year for reasons beyond WOBI\u2019s control, they may notify WOBI of a change in the pass holder at least five (5) days prior to the event. In such case, the Subscriber shall not be entitled to any refund, credit, courtesy, or compensation.<\/span><\/p>\n \u2013 If the Subscriber is unable to attend the WBF of the current year, they may attend the WBF of the following year (\u201cNext WBF\u201d) together with one (1) companion (courtesy of WOBI), provided that they: i) notify WOBI in writing at least forty-five (45) days prior to the event date; or \u2013 Memberships are not cancellable once the Subscriber has used (attended or transferred) the WBF ticket included in the Subscription.<\/span><\/p>\n \u2013 If the cancellation request complies with the requirements, WOBI will process the cancellation within sixty (60) calendar days. For the avoidance of doubt, such cancellation shall not entitle the Subscriber to any refund, credit, or compensation.<\/span><\/p>\n \u2013 In case the WBF is cancelled, modified, or cannot take place due to force majeure or circumstances beyond WOBI\u2019s control, WOBI shall not be obligated to provide any refund or compensation.<\/span><\/p>\n The Subscriber agrees to use WOBI services in accordance with applicable laws and these terms.<\/span><\/p>\n SECOND.- VALIDITY AND RENEWAL: The Subscription will be valid for 1 (one) year during which the Subscriber will be able to enjoy without restrictions all the benefits and digital and face-to-face services contracted in its plan or membership (\u201cTerm\u201c). Subscriber hereby agrees that the Subscription will be automatically and consecutively renewed for unlimited additional terms of 1 (one) year from the end of the Term of each Subscription. In any case, the Subscriber shall have the right to cancel the renewal of his subscription within 30 (thirty) calendar days following the time of renewal of the Term.<\/span><\/b><\/p>\n THIRD.- PRICE AND FORM OF PAYMENT: The fee for the service that WOBI grants to the Subscriber is established in accordance with the type of Subscription contracted, which will be accepted by the Subscriber at the time of the effective purchase, which must be settled in a single installment, considering of course various forms and\/or means of payment that will allow the Subscriber to have various payment methods. The Subscriber accepts and acknowledges that WOBI may carry out promotions and\/or marketing campaigns with different discounts and\/or prices at its sole discretion, without this generating a right to the Subscriber to receive any type of refund or compensation from WOBI.<\/span><\/b><\/p>\n Para utilizar ou usufruir dos servi\u00e7os e benef\u00edcios da sua Subscri\u00e7\u00e3o, o Subscritor dever\u00e1 disponibilizar uma ou mais formas de pagamento, tais como cart\u00f5es de d\u00e9bito, transfer\u00eancias banc\u00e1rias, cart\u00f5es de cr\u00e9dito e\/ou plataformas interm\u00e9dias que facilitem as transa\u00e7\u00f5es e pagamentos ou ainda carteiras eletr\u00f3nicas aceites pela WOBI (\u201cM\u00e9todo de Pagamento\u201d). Os M\u00e9todos de Pagamento aceitos em cada pa\u00eds ser\u00e3o publicados nos sites correspondentes a cada WBF e\/ou no site onde a Associa\u00e7\u00e3o for contratada. O Subscritor autoriza a WOBI a cobrar a sua Subscri\u00e7\u00e3o e Renova\u00e7\u00e3o utilizando qualquer M\u00e9todo de Pagamento associado \u00e0 sua conta, mesmo em caso de rejei\u00e7\u00e3o ou indisponibilidade do m\u00e9todo de pagamento principal. Quaisquer cobran\u00e7as pendentes ser\u00e3o da responsabilidade do Assinante. Se o pagamento da Subscri\u00e7\u00e3o e\/ou a sua renova\u00e7\u00e3o n\u00e3o puder ser efetuado de forma satisfat\u00f3ria, a WOBI poder\u00e1 suspender o seu acesso aos servi\u00e7os e benef\u00edcios da Subscri\u00e7\u00e3o at\u00e9 que a WOBI obtenha um m\u00e9todo de pagamento v\u00e1lido.<\/span><\/p>\n Membership for the WOBI service, as well as any other charges incurred by Subscriber in connection with Subscriber\u2019s use of the WOBI service, such as taxes and possible transaction fees, will be charged to Subscriber\u2019s Payment Method on the specific payment date indicated in the Subscription and\/or renewal agreement. Subscriber may authorize their Payment Method prior to collection of charges related to the Membership or service through various methods.<\/span><\/p>\n A presente Subscri\u00e7\u00e3o \u00e9 adquirida atrav\u00e9s de um pagamento \u00fanico, pelo que o Subscritor que tenha efetuado o pagamento ter\u00e1 direito a usufruir dos servi\u00e7os e\/ou benef\u00edcios de imediato e durante todo o Per\u00edodo da Subscri\u00e7\u00e3o, exceto nos casos de cancelamento ou rescis\u00e3o antecipada. Na medida do permitido pela lei aplic\u00e1vel e exceto conforme expressamente previsto no presente Contrato, os pagamentos n\u00e3o s\u00e3o reembols\u00e1veis \u200b\u200be n\u00e3o ser\u00e1 concedido qualquer reembolso ou cr\u00e9dito por per\u00edodos de subscri\u00e7\u00e3o parcialmente utilizados ou por Benef\u00edcios WOBI ou conte\u00fado n\u00e3o utilizado pelo Subscritor.<\/span><\/p>\n As taxas de impostos a cobrar ao Subscritor s\u00e3o baseadas nas taxas aplic\u00e1veis \u200b\u200bno momento da cobran\u00e7a anual. Estes valores podem mudar ao longo do tempo, dependendo dos requisitos fiscais locais do pa\u00eds, estado, territ\u00f3rio ou at\u00e9 mesmo da cidade de assinatura. Quaisquer altera\u00e7\u00f5es nas taxas de imposto ser\u00e3o aplicadas automaticamente de acordo com as informa\u00e7\u00f5es da conta fornecidas pelo Subscritor.<\/span><\/p>\n \u00c9 poss\u00edvel que a WOBI altere o pre\u00e7o, o tipo e\/ou os benef\u00edcios das Subscri\u00e7\u00f5es, pelo que, para efeitos de renova\u00e7\u00e3o das mesmas, a WOBI notificar\u00e1 o Subscritor de qualquer altera\u00e7\u00e3o de pre\u00e7o com uma anteced\u00eancia razo\u00e1vel. As altera\u00e7\u00f5es de pre\u00e7o entrar\u00e3o em vigor no in\u00edcio do pr\u00f3ximo per\u00edodo de Subscri\u00e7\u00e3o ou Prazo, ap\u00f3s a data da altera\u00e7\u00e3o de pre\u00e7o.<\/span><\/p>\n Se o Subscritor continuar a utilizar o Servi\u00e7o WOBI ap\u00f3s a altera\u00e7\u00e3o de pre\u00e7o entrar em vigor (na renova\u00e7\u00e3o), o Subscritor aceita o novo pre\u00e7o, sujeito \u00e0s leis da mat\u00e9ria. Caso o Subscritor n\u00e3o concorde com a altera\u00e7\u00e3o de pre\u00e7o, poder\u00e1 rejeit\u00e1-la cancelando a sua Subscri\u00e7\u00e3o, antes da entrada em vigor da altera\u00e7\u00e3o de pre\u00e7o.<\/span><\/p>\n FOURTH.- USE OF SUBSCRIBER’S PERSONAL DATA: \u00a0The Subscriber is responsible for any activity that occurs in the Subscription that it performs with WOBI. To help maintain control over your account and prevent any unauthorized users from accessing your account, you must maintain control over the devices used to access the service, and not disclose to anyone the password or Payment Method details associated with the account. Subscriber agrees to provide and maintain accurate information in connection with his\/her account, including a valid email address so that WOBI may send notices to him\/her about his\/her account. <\/span><\/b><\/p>\n WOBI may terminate Subscriber\u2019s account or suspend it in order to protect Subscriber, WOBI, or other subscribers to the service from identity theft or other fraudulent activity.\u00a0<\/span><\/p>\n A WOBI recolhe as seguintes categorias de informa\u00e7\u00f5es pessoais sobre o Subscritor:\u00a0<\/span><\/p>\n WOBI is committed to protecting the Subscriber\u2019s personal data. WOBI will implement appropriate technical and organizational measures in order to protect the security of the Subscriber\u2019s personal data. Algumas destas medidas incluem pol\u00edticas de encripta\u00e7\u00e3o, acesso e reten\u00e7\u00e3o.<\/span><\/p>\n \u00a0<\/span><\/p>\n FIFTH.- INTERNET PROTOCOL PROTECTION: \u00a0WOBI uses browser technology for several reasons, including providing its services; administering and developing its activities; researching, analyzing and improving its services; sending marketing and informational messages; managing its membership plans; protecting security and preventing fraud; and complying with the law.<\/span><\/b><\/p>\n These technologies allow WOBI to collect personal information when using its services. In addition, WOBI may collect information about the Subscriber\u2019s online activities over time, across different websites.<\/span><\/p>\n WOBI uses reconfigurable device identifiers to display marketing communications of its services or content on third-party services and to manage its membership plans. WOBI has reasonable administrative, logistical, physical, and managerial measures in place to protect Subscriber\u2019s personal information from loss, theft, and unauthorized access, use, and modification. These measures are intended to provide an adequate level of security against the risks of processing the Subscriber\u2019s personal information.<\/span><\/p>\n \u00a0<\/span><\/p>\n SEXTO.- UTILIZA\u00c7\u00c3O DE COOKIES E PROMO\u00c7\u00d5ES COMERCIAIS: <\/b>SA WOBI e as ag\u00eancias de publicidade utilizam cookies, outras tecnologias semelhantes e identificadores de dispositivos reconfigur\u00e1veis \u200b\u200bpara diferentes fins.<\/span><\/p>\n Os cookies s\u00e3o pequenos ficheiros de dados que s\u00e3o geralmente armazenados no seu dispositivo quando acede a sites e outros servi\u00e7os online. Se o Subscritor tiver d\u00favidas gerais sobre o servi\u00e7o WOBI, a sua conta ou como contactar o servi\u00e7o de apoio ao cliente, visite info@wobi.com.<\/span><\/p>\n OITAVO.- MODIFICA\u00c7\u00d5ES:<\/b> A WOBI poder\u00e1 proceder a modifica\u00e7\u00f5es \u00e0s Cl\u00e1usulas do presente Contrato, caso em que a WOBI notificar\u00e1 o Subscritor de tais altera\u00e7\u00f5es, por meios razo\u00e1veis, antes de estas entrarem em vigor. Al\u00e9m disso, tais altera\u00e7\u00f5es n\u00e3o se aplicam a lit\u00edgios entre o Subscritor e a WOBI que ocorram antes da data de publica\u00e7\u00e3o das modifica\u00e7\u00f5es. A utiliza\u00e7\u00e3o do servi\u00e7o WOBI ap\u00f3s altera\u00e7\u00f5es ao Contrato ser\u00e1 considerada como aceita\u00e7\u00e3o de tais altera\u00e7\u00f5es pelo Subscritor. Caso o subscritor deseje deixar de utilizar o servi\u00e7o WOBI devido a altera\u00e7\u00f5es no Contrato, poder\u00e1 contactar a WOBI para encerrar a sua conta. <\/span>a) <\/span>\u00a0They are a natural person of legal age, or a duly authorized representative of a legal entity, with full legal capacity and sufficient authority to enter into this Agreement by electronic or other means.
<\/span>b) \u00a0It is their intention to enter into this Agreement with WOBI, and by purchasing the products described herein, they acknowledge and accept the terms and conditions set forth in this Agreement.<\/span><\/p>\n
<\/strong>a) It is a group of companies operating under different corporate entities authorized to use the WOBI brand, all duly incorporated under the applicable laws of their respective jurisdictions.<\/span>
<\/span>b) \u00a0It is its intention to enter into this Agreement with the Subscriber.<\/span><\/p>\n
<\/span>WOBI offers Subscriber various membership plans, including the benefits listed on the WOBI website from which Subscriber has purchased their Membership (\u201cBenefits\u201c).<\/span><\/p>\n
<\/span>\u2013 If a subscriber is unable to attend the WBF of the current year for reasons beyond WOBI\u2019s control, the subscriber may inform WOBI about the change of pass holder at least 5 (five) days in advance of the date of the corresponding WBF. The user will not have any additional rights to refund, credit, courtesy, etc.
<\/span>\u2013 If\u00a0 Subscriber is unable to attend the WBF of the current year, the Subscriber will have the right to attend the WBF of the following consecutive year (\u201cNext WBF\u201c) together with one (1) other person as companion (courtesy of WOBI), provided that User shall: i) notify WOBI by writing with at least 45 (forty-five) days prior to the date of the corresponding WBF of the current year or ii) renew the membership for the next year
<\/span>\u2013 Memberships are not cancellable, for any reason, if the user has used (attended or transferred) the ticket to the corresponding WBF that was included in the Subscription.
<\/span>\u2013 If the cancellation request has complied with the aforementioned requirements, WOBI will proceed to make the refund no later than 60 (sixty) calendar days after the User has submitted their request.
<\/span>\u2013 In the event that the WBF corresponding to the Subscriber\u2019s Membership is canceled, modified, or cannot take place due to force majeure, unforeseeable circumstances, or events beyond WOBI\u2019s control (including, but not limited to, pandemics, natural disasters, terrorism, civil unrest, or government restrictions), WOBI will not be obligated to provide any refund for the amounts paid by the Buyer\/Subscriber in connection with their Membership.

<\/span><\/span>b) \u00a0IP addresses (which may be used to determine the Subscriber\u2019s general location, device, city, state\/province, and zip code);
<\/span>c)<\/span><\/span> Software and device characteristics, the referral source, registration information in the mobile app and in the standard web browser, and connection information, including type;
<\/span>d)\u00a0Performance data, such as crash reports, timestamps, debug log messages; and\u00a0<\/span>
